Questions Surround Wyoming’s Noxious Weed Seed Rule

There have been lots of questions about Wyoming’s noxious weed seed rule–specifically with regard to the state’s “regulated weed seed” list. Wyoming’s law, similar to other states, denotes “restricted” and “prohibited” status, each with similar regulations. Its “regulated” status is somewhat unique, and could affect an “all states” noxious weed seed listing on a seed tag. It is important to note that the weed seed list has specific tolerances, as follows:

  • Cheat Bromus secalinus L. – Tolerance shall be 1,200 seeds per pound
  • Downy brome Bromus tectorum L. – Tolerance shall be 1,200 seeds per pound
  • Feral rye Secale cereal L. – Tolerance shall be none (0) in small grains other than rye
  • Japanese brome Bromus japonicas Thunb. – Tolerance shall be 1,200 seeds per pound
  • Ripgut brome Bromus rigidus Roth – Tolerance shall be 1,200 seeds per pound

If those tolerances are not met, then the weed seed does not need to be noted on the seed tag as “prohibited” or “restricted” in an “all states” listing. For questions, contact Pat Miller.
