Navigating the Temporary Suspension of the OSHA “Vaccinate or Test” Mandate

The U.S. Court of Appeals for the Fifth Circuit recently issued a temporary order suspending the Occupational Health and Safety Administration’s (OSHA) emergency temporary (ETS) “vaccinate-or-test” mandate. ASTA’s legal counsel, Hogan Lovells, has developed a document which analyzes how multiple appeals may be handled across the country, whether the Supreme Court or another court will weigh in, and how employers should prepare during this period.
